The answer can have a profound impact on how much tax you pay . Independent contractors are required to pay self-employment taxes: the employee's share of social security and medicare tax, and the employer's matching share, as well as income tax. Generally, whether a worker is an employee or an independent contractor depends upon how much control the worker has over the work performed. If you have the right to control how and when your work is to be done then you are most likely an independent contractor. If you think you are an employee, but your employer is not deducting taxes from your wages you should ask the IRS to make a determination on whether you are an independent contractor or an employee by filing a Form SS-8, Determination of Worker Status for Purposes of Federal Employment Taxes and Income Tax Withholding, with the IRS.
